What is the average rental rate for cell towers in my area?

What’s the difference between an Option Lease and Ground Lease or Rooftop Lease?

An option lease give the cell tower developer the option to tie up your property and conduct their due diligence on your site, making sure they can get their permits and actually build the cell site. Option lease agreements turn into lease agreements when they exercise their Option, or send you a Commencement Letter. Landlords are typically offered a $500 option payment per year. Is that what you should agree to? Probably not. A ground lease (land lease) or rooftop lease does not have an option period.

How long does it take to negotiate a cell tower lease agreement?

The cell tower lease negotiation process can take a few minutes if you sign the “take it or leave it” lease template they hand you. Or it can take 3 to 6 months in most cases, or ever a year or longer, depending on the complexities of the property and the terms that need to be negotiated. Think of it as a steak. You can get a McDouble in 3 minutes at the mcDonald’s drive-thru, or you can dry age a steak for a month before it is ready to be thrown on the grill.

What if the real estate site acquisition agent said I have to sign a term sheet?

It’s always used to pin you in a corner, even if they tell you it’s not legally binding. Tell them your WORD is good enough. You need to be shrewd when dealing with the cell tower real estate leasing representatives.

Is this cell tower proposal even legit?

Some cell tower developers are really just trying to get property owners to sign a term sheet or option lease agreement to use as leverage against a competing property and have no intention of ever building a cell tower on your property. Unfortunately there is really no way to be 100% sure. Leasing property for cell tower development comes with rewards but risks as well.
