Negotiating Your Newly Proposed Cell Tower or Cell Site Lease Agreement Doesn’t Need to Be Stressful.
Help Has Arrived.
Tower Genius helps people who were handed a new cell tower lease proposal and who need fast accurate information. We’re not cell tower attorneys. We’re consultants. But lawyers from all over the USA contact us every month requesting our cell site lease consulting services to get help for their clients who need to respond quickly to cell tower offers. Tower Genius is laser-focused on helping people achieve the best possible outcomes with their cell tower lease agreements. We are known to some as “wireless leasing beauticians” who turned their ugly cell site lease agreements beautiful again. And our Partners Kevin Donohue and Steve Kazella are known to many as “cell tower alchemists”, who have turned their cell tower lease agreements into paper gold.
We’ve been helping landlords and property owners exclusively since 2008, when we stopped working for the carriers and tower companies, because we witness the heavy-handed bully tactics used by the industry against cell tower landlords and we decided to do something about it. As a result we’ve helped thousands of people from a couple of retired farmers in Nebraska, to a couple of Google Millionaire clients in San Francisco, attorneys from all over the United States, Fortune 500 companies, mega-churches, small rural churches, real estate developers, ranchers, municipalities, water companies, electrical utility companies, zoos, cemeteries, hospitals, country clubs, hotels, resorts and every day people with cell towers on their property. How does Tower Genius help with cell tower offers? One client at a time.
One of the huge benefits of working with Tower Genius, when Kevin and Steve are on your team, you are tapping into 50+ years of combined experience in cell tower infrastructure leasing and development. There is literally nothing that we have not seen in our career, no question we can’t answer or myth we can’t debunk. It’s our privilege to help our clients succeed with their cell tower negotiations and expedite their new lease agreements, amendments and cell tower lease buyout transactions.
The only thing uglier than an ugly cell tower, is a poorly structured lease agreement that could have been prevented with the proper review, consultation and transactional coaching. We want to help you to level the cell tower playing field and get a fair and balanced tower contract.
Okay, you have some questions…
- What is the average rental rate for cell towers in my area?
- What’s the difference between an Option Lease and Ground or Rooftop lease?
- How long does it take to negotiate a cell tower lease agreement?
- What if the real estate acquisition agent said I have to sign a term sheet?
- I think the cell phone tower rep gave me a low-ball offer. What should I do?
- Is this cell tower rental proposal even legit?
What is the average rental rate for cell towers in my area?
How we help with cell tower offers when determining rent value is helping property owners to understand that cell site rental rates are site-specific. There is no such thing as an average cell tower lease rate as far as Tower Genius’ clients are concerned, but there are many cell tower landlords who settle for the status quo. Don’t be average.
What’s the difference between an Option Lease and Ground Lease or Rooftop Lease?
An option lease give the cell tower developer the option to tie up your property and conduct their due diligence on your site, making sure they can get their permits and actually build the cell site. Option lease agreements turn into lease agreements when they exercise their Option, or send you a Commencement Letter. Landlords are typically offered a $500 option payment per year. Is that what you should agree to? Probably not. A ground lease (land lease) or rooftop lease does not have an option period.
How long does it take to negotiate a cell tower lease agreement?
The cell tower lease negotiation process can take a few minutes if you sign the “take it or leave it” lease template they hand you. Or it can take 3 to 6 months in most cases, or ever a year or longer, depending on the complexities of the property and the terms that need to be negotiated. Think of it as a steak. You can get a McDouble in 3 minutes at the mcDonald’s drive-thru, or you can dry age a steak for a month before it is ready to be thrown on the grill.
What if the real estate site acquisition agent said I have to sign a term sheet?
At Tower Genius LLC, how we help with cell tower offers is that we always recommend that property owners do not sign a term sheet. It’s always used to pin you in a corner, even if they tell you it’s not legally binding. Tell them your WORD is good enough. You need to be shrewd when dealing with the cell tower real estate leasing representatives.
I think the cell phone tower rep gave me a low-ball offer? What should I do?
Tell them you need to see a lease agreement. Get it in Word format. Tell them to send out their survey crew to get you a site plan. Then call Tower Genius at 1-888-313-9750.
Is this cell tower proposal even legit?
Some cell tower developers are really just trying to get property owners to sign a term sheet or option lease agreement to use as leverage against a competing property and have no intention of ever building a cell tower on your property. Unfortunately there is really no way to be 100% sure. Leasing property for cell tower development comes with rewards but risks as well.
